Artificial intelligence is fast taking the centre stage in today’s digital landscape, reshaping the way companies collect data, store, and process it. While this intersection between AI and data has emerged as a critical focal point, significant ethical concerns arise about the use of personal data and the potential risks in AI. With that said, data protection laws need to be evolved to adapt to the changing data privacy protection landscape.

In this article, we will dig deeper into the scope, challenges, and probable solutions to AI in data protection.

What is Data protection?

Data protection is the process of safeguarding an individual’s data by ensuring secure collection, retention, and processing by a business. Different laws and regulations have been imposed on businesses worldwide to ensure no personal data is misused and handled securely. 

However, with the advent of AI technologies, advanced large language models (LLMs), AI chatbots, and more, the data protection landscape faces privacy challenges.  

Data Privacy Concerns with AI

  • Privacy: Generative AI models gather a massive volume of data to augment decision-making and enhance their algorithms through web scraping. This data can include personal information, more alarmingly, without explicit consent of the holder of this data. This collection of data without the knowledge of data holders can cause businesses to face serious legal repercussions, hefty fines, etc., under data privacy laws like GDPR. In addition, AI applications offer less command to the data subjects about what information they collect and how that data is processed or can be erased. Thus, data scrapping can pose significant privacy risks, making data vulnerable to disclosure through AI outputs. 
  • Security: Companies that use AI systems to collect or process data are vulnerable to cyberattacks. Security holes – both internal and external – if exploited – can lead to compromise of the system. The result is a cyberattack or data exfiltration and compromised data integrity.
  • AI Bias: Bias with AI systems is another critical challenge facing data protection methods and regulations. AI algorithms can inherently include bias. It means with a biased input, you will get a biased output. 
  • Mis/Disinformation: Scammers can use AI to trick people into handing over their sensitive information or spreading misinformation. It can result in data theft.

With that said, failing to address the aforementioned challenges while leveraging AI in data processing can lead to non-compliance with data protection laws. 

To comply with data privacy laws, organisations should adopt some strategies:

Transparency

Organisations should ensure transparency while using AI tools to collect or process customer data. They should be mandated to provide clear information to consumers about how their data is being collected, processed, or shared. Consumers should be informed about the purpose of data collection and given the right to exert control over it – the right to access, edit, or ask for data deletion. 

Consent

Before collecting personal data, organisations should be obliged to inform data subjects of the involvement of AI tools. In addition, specific and unambiguous consent for the organisations should be given by data subjects voluntarily. Consent is an agreement that signifies the affirmation of a consumer to the processing of their data. 

Decision-Making

Data protection laws should be evolved enough to empower data subjects with the right to opt out of any decision made solely based on automated processing and profiling. It implies that organisations must be aware of the potential impacts of AI on personal data and ensure their decisions don’t affect or create any legal implications on the data subjects. 

Needless to mention, AI has sped up the way data is being collected, processed, and shared by business. However, this transformative change has mandated businesses to operate AI systems within a defined framework that aligns with the established ethical standards of the data protection law of a country. For example, the EU AI Act, a legislative proposal soon to be implemented was presented by the EU Commission to ensure fair, transparent, and lawful use of AI systems in data processing across the European Union. 

The Comprehensive privacy principles of the EU AI Act are:

Human Oversight and Accountability

According to this act, AI systems are not a replacement for humans but a complement to human effort. In addition, these systems should be transparent enough and provide clear information about the recommendations they make. Humans should be allowed to make informed decisions and intervene whenever necessary. Organisations using an AI tool should be accountable for the actions and repercussions of using it. 

Technical Robustness and Safety

AI systems handling consumer data should be designed in a way that promotes trustworthiness and technical robustness. To ensure technical safety, rigorous system testing and validation have been mandated in the Act. Thus, loopholes can be tracked down and addressed immediately. The aim is to develop an AI system that can address the intended purpose accurately without posing risks to individuals’ personal data. 

Privacy and Governance 

This principle mandates organisations dealing with personal data to abide by the guidelines and the stringiest technical and organisational measures detailed in the Act regarding data processing with AI systems. The aim is to ensure lawful, fair, and transparent data processing with AI systems. Under the EU AI Act, AI systems should comply with the “privacy by design and by default” concept – a fundamental principle introduced in GDPR.

The data governance principle details specific data provisions aiming to secure personal data from data breaches, data theft, unauthorised access, or disclosure of data. These provisions empower subjects with the right to access, edit, or even erase their data from the system. 

Transparency

This principle mandates AI developers to design AI systems that foster transparency. The developers must provide detailed information about:

  • The purpose of the AI system developed
  • The data processed by the system and 
  • the decision made by the system

On the other hand, details should be provided about the purpose and the practices of data processing adopted by a company, the categories of data involved in processing, the legal basis for data processing, etc.

Diversity, Non-Discrimination, and Fairness

These are the three pillars of AI systems that promote ethical development and deployment. 

  • Promoting diversity in development brings experiences, new ideas, and perspectives to a single table that fosters innovation.

 

  •  Non-discrimination means organisations are bound to take proactive and effective measures to ensure their AI models don’t exhibit any bias or discrimination. The aim is to enable fair, transparent, and accountable decision-making with AI systems free of discrimination while also promoting equality.

 

  • According to the Fairness principle, organisations are mandated to devise proactive and stringent policies and strategies to evade bias while using AI systems in the data processing. 

Social and Environmental Benefits

This principle encourages organisations to develop AI systems in a way that promotes inclusive and sustainable growth. 

Data protection is more than ensuring compliance with data protection laws. To escape any compromise of the data integrity of the data subjects, organisations handling personal data should:

  • Collect, store, and process customer data in a way that complies with the enforced data protection law in that area

 

  • deploy stringent data protection methods and strategies to evade unauthorised access, misuse, or exfiltration of customers’ sensitive personal information

 

  • Enable periodic risk assessment of AI systems on individuals and society and promote responsible and ethical handling of data with AI systems.
  • Design AI systems with processes that allow subjects to request access, edit, or correct their data.

 

  • Keep data subjects inside the loop and allow them to delete or restrict the processing of their personal information by the AI system.

 

  •  enable regular auditing and monitoring of the system to ensure no personal data is being used for any illegitimate system. That being said, any illegitimate use should be penalised.

 

  • Stringent governance frameworks should be established that organisations must adhere to while using AI systems in the data processing. 

That being said, despite the aforementioned challenges, AI can help organisations adhere to data protection laws. For example, advanced AI algorithms can track down sensitive personal information from a massive volume of data in a short time and enable accurate data mapping, correction, or erasure.

In short, organisations should strike a balance between deploying advanced technologies such as AI and data protection while also ensuring compliance with data privacy laws and frameworks.
